El artículo 422 de la constitución ecuatoriana surge de la experiencia de Ecuador con el arbitraje internacional. El país enfrentó casos devastadores como los de Occidental Petroleum (donde Ecuador fue condenado a pagar US$1.770 millones) y Chevron, donde en 2018 un tribunal de arbitraje internacional anuló la sentencia de US$9.500 millones que tribunales ecuatorianos habían ordenado a Chevron pagar por contaminar la Amazonía durante décadas.
