by Federica Tiefenthaler

Foley Hoag LLP advised the Russian Federation on the deal.

The Paris Court of appeal set aside the arbitral award issued in the dispute Oschadbank v. the Russian Federation, finding that the tribunal lacked temporal jurisdiction and therefore that the State did not consent to arbitrate the dispute.

The award set aside in its entirety yesterday was rendered by an arbitral tribunal seated in Paris on November 26, 2018 (PCA Case n° 2016-14).

The Foley Hoag team that defended the Russian Federation before the Paris Court of appeal was composed of partner Andrea Pinna (Picture), who leads the firm’s International Litigation & Arbitration practice in Foley Hoag’s Paris office, partner Diana Paraguacuto-Mahéo, counsel Anne-Fleur Dory and associate Margaux Méry, all located in Foley Hoag’s Paris office.
